1. REGISTRO; REPRESENTAÇÕES DO USUÁRIO.

Para acessar ou usar os Sites e/ou Serviços, você deve se registrar em uma conta e fornecer as informações conforme solicitado pelo formulário de registro da conta. Você declara e garante que (a) tem pelo menos 18 anos de idade, tem o direito e a autoridade para celebrar este Contrato e é totalmente capaz e competente para satisfazer os termos e condições deste Contrato; (b) todas as informações de registro necessárias que você enviar são atuais, completas, verdadeiras e precisas, e você manterá e atualizará imediatamente essas informações para mantê-las atualizadas, completas, verdadeiras e precisas; e (c) usará suas dos Sites e/ou Serviços cumprirão todos os termos deste Contrato e todas as leis aplicáveis.
Participation in this Program is entirely voluntary and subject to the terms set forth below. By submitting content, you (“Creator”) confirm that you have read, understood, and agreed to these Terms & Conditions, including DeepBrain AI’s Privacy Policy and Terms of Use.

2. ESCOPO DA LICENÇA; ATUALIZAÇÃO.

2.1 Creator Qualification

Sujeito ao Contrato, a Empresa concede a você uma licença intransferível, não exclusiva, revogável e limitada para acessar e usar os Sites e Serviços exclusivamente para seu uso pessoal ou comercial. A Empresa se reserva o direito, mas não a obrigação, de atualizar, modificar, suspender, apoiar, manter ou descontinuar os Sites ou Serviços, no todo ou em parte, a qualquer momento, com ou sem aviso prévio.

1. Submit an application through the official AI Studios Creator Submission Form and be accepted by DeepBrain AI as a verified creator. Submissions from non-verified creators will not be accepted or reviewed.
2. Be at least 18 years old or the age of majority in your jurisdiction of residence.
3. Not be an employee, contractor, consultant, or direct affiliate of DeepBrain AI, nor an immediate family member of any such individual.

2.2 Platform Eligibility

Creators must actively publish on at least one of the following platforms, meeting the associated follower or subscriber thresholds:

Accounts must be public, accessible for review, and in good standing (i.e., not suspended, restricted, or under investigation by the platform).

2.3 Jurisdictional Considerations

Participation is void where prohibited by local laws. It is the Creator’s responsibility to comply with applicable laws and regulations in their home country or region.

5. ATIVIDADES PROIBIDAS.

4.1 General Requirements

1. Reproduzir, vender, revender, arrendar, alugar, transferir, distribuir, hospedar ou explorar comercialmente os Sites ou Serviços ou qualquer software, tecnologias, componentes e conteúdos relacionados a eles (coletivamente, o “Software Licenciado”) ou usá-los para qualquer finalidade que não seja permitida pela Empresa;
2. Modificar, criar trabalhos derivados, desmontar, descompilar, fazer a compilação reversa ou fazer engenharia reversa do Software Licenciado;
3. Baixar, copiar ou coletar informações que possam ser usadas para copiar todo ou qualquer parte do Software Licenciado ou permitir o acesso ou o uso do Software Licenciado por qualquer pessoa ou entidade não autorizada;
4. Use o Software Licenciado para criar, coletar, carregar, transmitir, exibir ou distribuir qualquer conteúdo que (i) viole os direitos de terceiros, (ii) seja ilegal, assediador, abusivo, ilícito, ameaçador, invasivo da privacidade de outra pessoa, difamatório, falso, enganoso, pornográfico, obsceno, ofensivo, racista, prejudicial ou seja censurável a qualquer grupo ou indivíduo, ou (iii) esteja violando qualquer lei, regulamento ou obrigações ou restrições impostas por terceiros;Creator Promotion Video Submission Form
5. Carregar, transmitir ou distribuir quaisquer vírus de computador, worms, cavalos de Tróia, bombas-relógio, bombas lógicas, cancelbots, arquivos corrompidos ou qualquer outro software destinado a danificar ou alterar os Sites, Serviços ou qualquer sistema de computador ou dados relacionados a eles;
6. Enviar por meio dos Sites ou Serviços publicidade não solicitada ou não autorizada, materiais promocionais, lixo eletrônico, spam, material de campanha política, cartas em cadeia, oferta de marketing multinível ou qualquer outra forma de mensagens duplicadas ou não solicitadas, comerciais ou não;

4.2 What Counts as Original Content

Videos may include a wide range of creative assets, as long as the creator has the legal right to use them. Acceptable content includes:

1. Real footage recorded by the creator
2. AI-generated visuals, images, or videos created by the creator using AI Studios tools
3. Custom AI avatars or voice clones generated within AI Studios, provided the creator:
   - Personally owns the rights to the likeness, voice, or identity used, or
   - Has clear, documented consent from the individual being represented
4. Uploaded content (e.g., images, audio, or video) as long as the creator owns the rights or has obtained proper licensing or permission to use it
5. Stock assets made available directly through AI Studios, including:
   - Music, sound effects, images, and video clips sourced from integrated libraries like Pixabay and Shutterstock
   - Built-in AI voices provided within the AI Studios platform
   - Default avatars and character presets available for creator use

Creators are encouraged to make full use of the tools, voices, avatars, and assets provided in AI Studios. However, submissions must show clear creative input, such as original scripting, scene design, or layout adjustments. Videos that consist solely of unedited templates or default content without any meaningful customization will not be accepted.

4.3 Prohibited Content

The following types of content are ineligible and may result in rejection or disqualification:

1. Reposts or reused content not originally created by the submitting user
2. Duplicate or re-uploaded versions of the same video on the same platform
3. Videos that remove, obscure, or manually edit the AI Studios watermark
4. Content that uses unauthorized voice clones, avatars, or likenesses
5. Deepfake content impersonating real people (public figures, private individuals, or minors) without consent
6. Compilations that include third-party audio or video without proper rights
7. Videos containing hate speech, nudity, harassment, misinformation, or politically sensitive or unsafe material
8. Submissions made more than 60 days after the video’s publish date

DeepBrain AI reserves the right to reject, disqualify, or retroactively remove any submission that violates these standards, even if it was previously approved.

4.4 Legal Responsibility

Creators are fully responsible for securing all necessary rights to the media assets used in their submissions. This includes, but is not limited to:

1. Voice models and likenesses
2. External media
3. AI-generated characters or voices
4. Any third-party content used in editing

DeepBrain AI reserves the right to request proof of ownership or consent at any time. If such proof cannot be provided, the submission may be disqualified.
DeepBrain AI is not liable for any legal disputes, copyright claims, takedowns, platform enforcement actions, or financial penalties resulting from a creator’s content. All responsibility for compliance and consequences lies with the creator.

6. DIREITOS DE PROPRIEDADE E PROPRIEDADE INTELECTUAL.

O conteúdo, documentos, informações, materiais, organização, gráficos, design, compilação, conversão digital e as ideias, procedimentos, processos, sistemas, métodos e conceitos incorporados nos Sites, nos Serviços ou em outros serviços de terceiros relacionados de alguma forma aos Sites ou Serviços serão os direitos autorais, marcas registradas, segredos comerciais e/ou outras propriedades proprietárias ou intelectuais da Empresa. Sua licença para acessar ou usar os Sites ou Serviços não é uma venda de uma cópia, redistribuição, uso ou publicação desse Software Licenciado (exceto para o único propósito de Uso Permitido, conforme definido acima) e não o torna proprietário dessa cópia, restrição, uso ou publicação do mesmo. A propriedade do Software Licenciado e de todos os componentes e tecnologias relacionados permanecerão sempre com a Empresa, independentemente de quem possa ser considerado o proprietário da mídia tangível na qual ou na qual o Software Licenciado possa ser copiado, codificado ou corrigido de outra forma.

1. A non-exclusive, royalty-free, perpetual, irrevocable, worldwide license to use, modify, distribute, publish, repurpose, and repost the submitted content
2. The right to feature your video in paid advertisements, websites, product pages, app listings, event presentations, investor materials, and social media campaigns
3. The ability to attribute your username or handle when reposting your content, though this is not required

This license does not require additional approval or compensation. Creators retain ownership of their original work but waive any claims to further compensation, licensing fees, or takedown rights related to usage within the scope described above.

6.1 Monthly Submission Cap

1. A single video posted on multiple platforms can be submitted separately for each version.
2. However, only one bonus is awarded per platform per video.
3. Multiple uploads of the same video to the same platform (even under different accounts) will not receive multiple rewards.
4. Re-edited versions with minor changes will still be considered duplicate if the core content is identical.

3. Submissions are locked at the time of entry. The view count for that specific video on that specific platform is the only metric used for reward eligibility.

6.4 60-Day Tracking Window

1. DeepBrain AI will begin tracking views from the day a video is first published publicly.
2. Only views accumulated within the 60-day window will count.
3. Private, hidden, or deleted videos during the tracking period will be automatically disqualified.

8. CONTEÚDO DO USUÁRIO.

However, if the same video is submitted on multiple platforms and meets the view threshold independently on each, it can earn up to $500 per platform (e.g., TikTok, Instagram, YouTube), for a potential combined total of $1,500. Each creator can earn a maximum of $1,500 per month in cash rewards.

3. DeepBrain AI does not guarantee the uniqueness, exclusivity, or legal status of the generated content.

9. ISENÇÃO DE GARANTIA.

8.1 Method of Payment

1. Rewards are issued via PayPal only.
2. Creators are responsible for providing an accurate and valid PayPal email address during onboarding or upon request.
3. DeepBrain AI is not responsible for failed or misdirected payments resulting from incorrect or outdated information submitted by the creator. In such cases, the reward will be considered fulfilled, and DeepBrain AI is not obligated to recover or reissue the payment.
4. Creators may request a review of the transaction. DeepBrain AI may, at its sole discretion, investigate and determine whether corrective action is appropriate. Any resolution will be handled on a case-by-case basis and will not establish a precedent for future claims.

8.2 Timing and Processing

1. Payments are typically processed within 30 days following the end of the 60-day tracking window.
2. However, processing times may vary depending on the volume of submissions, holidays, verification requirements, or unforeseen operational delays.
3. DeepBrain AI is not responsible for payment delays and does not guarantee delivery within a fixed timeframe.

8.3 Currency and Fees

1. Rewards are issued in USD by default.
2. Creators are responsible for any transaction, currency conversion, or third-party processing fees. These fees will be deducted from the total payout amount.
3. Requests for payment in other currencies may be submitted but are not guaranteed and are subject to DeepBrain AI’s discretion and processing capabilities.

8.4 Taxes

1. All local, national, or international tax obligations related to payouts are the sole responsibility of the creator.
2. DeepBrain AI does not provide tax documentation unless legally required.

8.5 Creator Information Updates

1. If the creator needs to update their PayPal email address, contact information, or any other details relevant to payment or account identification, they must notify DeepBrain AI in writing.
2. Changes will only be recognized once confirmed by DeepBrain AI. Failure to provide timely written notice may result in delayed or misdirected payments, for which DeepBrain AI is not responsible.
3. Regardless of any updates, all video submissions must come from the same social media account originally registered and approved through the Creator Submission Form, unless prior written approval is granted by DeepBrain AI.

10. LIMITAÇÃO DE RESPONSABILIDADE.

EM NENHUM CASO, A EMPRESA SERÁ RESPONSÁVEL PERANTE VOCÊ OU QUALQUER OUTRA PESSOA POR QUAISQUER LUCROS PERDIDOS, ECONOMIAS PERDIDAS, DADOS PERDIDOS OU OUTROS DANOS ESPECIAIS, CONSEQUENCIAIS OU INCIDENTAIS DECORRENTES OU RELACIONADOS A ESTE CONTRATO OU A QUALQUER PRODUTO OU SERVIÇO FORNECIDO OU A SER FORNECIDO PELA EMPRESA, SEJA O SOFTWARE LICENCIADO OU QUALQUER SOFTWARE DE TERCEIROS, SOB ESTE CONTRATO OU SEU USO, MESMO QUE A EMPRESA TENHA SIDO AVISADA DA POSSIBILIDADE DE TAL PERDA OU DANO. NÃO OBSTANTE QUALQUER DISPOSIÇÃO CONTRÁRIA A ESTE DOCUMENTO, A RESPONSABILIDADE AGREGADA DA EMPRESA SOBRE QUAISQUER REIVINDICAÇÕES DECORRENTES OU RELACIONADAS A ESTE CONTRATO OU A QUAISQUER PRODUTOS OU SERVIÇOS FORNECIDOS OU A SEREM FORNECIDOS PELA EMPRESA NOS TERMOS DESTE CONTRATO SERÁ, EM QUALQUER CASO, ABSOLUTAMENTE LIMITADA AO VALOR PAGO POR VOCÊ À EMPRESA NOS TERMOS DESTE CONTRATO.

1. Use artificial methods to inflate views, including bots, fake engagement tools, or paid traffic services
2. Submit plagiarized, duplicated, or otherwise ineligible content on a repeated or intentional basis
3. Violate DeepBrain AI’s Terms of Use, these Program Terms, or the content and community standards of the platforms they post on
4. Attempt to manipulate view tracking by deleting, re-uploading, editing post visibility, or misleading the submission process in any way

Disqualification may occur at any time and without prior notice. DeepBrain AI reserves full discretion to reject any creator or submission for any reason it deems appropriate. All decisions are final and not subject to appeal.

11. INDENIZAÇÃO.

12. SOLTAR.

No caso de você ter uma disputa com qualquer outro usuário (s) dos Sites ou dos Serviços, você isenta a Empresa e seus executivos, diretores, agentes, subsidiárias, joint ventures e funcionários de quaisquer reivindicações, responsabilidades, custos e despesas, demandas e danos, reais ou consequenciais, de todo tipo e natureza, conhecidos e desconhecidos, suspeitos e insuspeitos, divulgados e não divulgados, decorrentes ou relacionados a tais disputa.

3. Delayed or failed payments due to inaccurate creator information
4. Local laws that may restrict creator eligibility or earnings

Participation is voluntary and at the creator’s own risk.

14. DIREITOS DE PUBLICIDADE.

A Empresa se reserva o direito, diretamente ou em parceria com uma pessoa ou entidades terceirizadas, de vender, licenciar e/ou exibir qualquer publicidade, atribuição, links, direitos promocionais e/ou de distribuição relacionados ao seu uso dos Sites ou Serviços, e terá o direito de reter qualquer receita gerada por quaisquer vendas ou licenças de tais direitos de publicidade, atribuição, links ou promoção ou distribuição.
